Returns

Returns & Refund Policy

1. Application

This policy applies to sales made by Yellowstone Machinery Ltd.

Customers are classified as either:

  • Private Consumers – individuals purchasing wholly or mainly outside the course of a trade, business or profession; or
  • Business Customers – individuals or organisations purchasing wholly or mainly for trade, business or professional purposes.

Different rights and conditions apply depending on the customer classification.

A. PRIVATE CONSUMERS

2. Consumer Returns – 14-Day Cooling-Off Period

Private Consumers purchasing online have the right to cancel eligible orders within 14 days of receiving the goods, in accordance with the Consumer Contracts Regulations 2013.

To exercise the right to cancel, the customer must notify Yellowstone Machinery within the cancellation period at:

contact@yellowstonemachinerysupply.com

The customer then has a further 14 days to return the goods, unless Yellowstone Machinery has agreed to collect them.

Certain goods may be excluded from the right to cancel where an applicable legal exemption applies, including goods made or customised specifically to the customer's requirements.

3. Condition of Returned Goods

Consumers may inspect and handle goods only to the extent reasonably necessary to establish their nature, characteristics and functioning.

Returned goods should, wherever reasonably possible, include:

  • All supplied parts and accessories
  • Manuals and documentation
  • Keys and tools
  • Original packaging where available

Yellowstone Machinery may make a deduction from the refund where handling or use beyond what is reasonably necessary has reduced the value of the goods.

For machinery, this may include reduction in value caused by significant operating hours, wear, damage, excessive dirt or contamination, missing components or other evidence of use beyond reasonable inspection.

Any deduction will reflect the actual reduction in value rather than a fixed handling charge.

4. Faulty, Damaged or Misdescribed Goods

Private Consumers have statutory rights where goods are faulty, not as described, not fit for purpose or otherwise fail to meet the requirements of the Consumer Rights Act 2015.

Customers should contact Yellowstone Machinery as soon as reasonably possible at:

contact@yellowstonemachinerysupply.com

This Returns Policy does not restrict or replace those statutory rights.

5. Inspection on Delivery

Customers should inspect their machine as soon as reasonably possible following delivery.

Any visible transport damage, missing items or obvious issues should be reported to Yellowstone Machinery promptly, together with photographs where possible.

Reporting visible damage promptly helps us investigate the matter with the delivery provider but does not remove a Private Consumer's statutory rights.

6. Return Costs

Where a Private Consumer cancels an order because they have simply changed their mind, the customer is responsible for the direct cost of returning the goods where permitted by law and where they were informed of this responsibility before purchase.

Machinery and other large items cannot normally be returned by standard post. Where applicable, information regarding the estimated cost of returning such goods will be provided before the order is placed.

Customers should not arrange the return of machinery without first contacting Yellowstone Machinery.

Where goods are faulty, incorrect or otherwise subject to a statutory remedy, Yellowstone Machinery will meet any return or collection costs that it is legally required to bear.

7. Consumer Refunds

Refunds will be made to the original payment method.

Where a consumer cancels an eligible online order, Yellowstone Machinery will process the refund without undue delay and within the period required by law.

Where the customer is responsible for returning the goods, Yellowstone Machinery may normally wait until the goods have been received back, or evidence of return has been provided, before issuing the refund.

Where applicable, the cost of Yellowstone Machinery's standard delivery option will also be refunded. Any additional amount paid for an enhanced or premium delivery service is not refundable beyond the cost of the standard delivery service.

B. BUSINESS CUSTOMERS

8. Business Purchases

Consumer cancellation rights do not apply to Business Customers.

Business Customer returns for change of mind are accepted solely at the discretion of Yellowstone Machinery and only where agreed in writing before the goods are returned.

No Business Customer has an automatic right to return goods simply because they are no longer required.

9. Inspection and Delivery Damage

Business Customers must inspect goods promptly following delivery or collection.

Visible:

  • Transport damage
  • Shortages
  • Incorrect items
  • Obvious defects

should be reported to Yellowstone Machinery within 48 hours of delivery or collection, wherever reasonably possible.

Latent faults which could not reasonably have been identified during initial inspection should be reported promptly after discovery and will be considered in accordance with the applicable warranty and terms of sale.

10. Business Change-of-Mind Returns

Where Yellowstone Machinery agrees to accept a Business Customer return for change of mind, the goods must normally be:

  • Unused
  • Unmodified
  • Complete
  • In fully resalable condition
  • Supplied with all accessories, tools and documentation
  • In the original packaging where reasonably applicable

Used, fitted, operated, altered or modified goods will normally not be accepted for change-of-mind return.

Yellowstone Machinery may refuse any discretionary return that does not meet these requirements.

11. Business Restocking and Handling Charges

Where a discretionary Business Customer return is accepted, Yellowstone Machinery may apply the following restocking and handling charges:

  • Machines: 25% of the returned machine price
  • Parts, attachments and accessories: 30% of the returned item price

Additional deductions may be made where returned goods are incomplete, damaged or have suffered a reduction in value beyond normal handling.

Any return must be approved by Yellowstone Machinery before being sent.

12. Business Faults

Where a Business Customer believes goods are defective, the customer must notify Yellowstone Machinery promptly and provide reasonable information required to investigate the issue.

Yellowstone Machinery may require:

  • Photographs
  • Video evidence
  • Machine serial number
  • Operating-hour reading
  • Maintenance information
  • Return of the affected component
  • Inspection of the machine

Customers must not commission third-party repairs with the expectation that Yellowstone Machinery will reimburse those costs unless the work and cost have been approved by Yellowstone Machinery in writing beforehand.

Warranty claims are subject to the separate Yellowstone Machinery Warranty Policy.

13. Business Return Costs

Unless Yellowstone Machinery expressly agrees otherwise in writing:

  • Business Customer returns are at the customer's cost
  • Collection and transportation costs are the customer's responsibility
  • The customer is responsible for safely preparing the machine or goods for transport
  • The customer bears the risk of returned goods until they are received by Yellowstone Machinery

Failed collections or additional carrier charges caused by inadequate access, incorrect information or goods not being ready for collection may be charged to the customer.

14. Business Refunds

Where a Business Customer return has been approved, any refund will be calculated after applicable:

  • Restocking or handling charges
  • Transport costs
  • Missing items
  • Damage
  • Reduction in value
  • Other amounts properly due under the sale

Approved refunds will be returned to the original payment method unless otherwise agreed.

15. Business Losses

To the fullest extent permitted by law, Yellowstone Machinery will not be responsible to Business Customers for:

  • Loss of profit
  • Loss of revenue
  • Loss of business
  • Loss of contracts
  • Downtime
  • Loss of use
  • Replacement-machine hire
  • Indirect or consequential losses

Nothing in this policy excludes any liability which cannot lawfully be excluded.

C. GENERAL TERMS

16. Returns Authorisation

Customers must contact Yellowstone Machinery before returning a machine, attachment, part or accessory.

Goods must not be returned to Yellowstone Machinery's registered office unless specifically instructed to do so.

contact@yellowstonemachinerysupply.com

17. Collections

Where goods were collected by a Business Customer, the Business Customer remains responsible for arranging and paying for any approved return unless Yellowstone Machinery agrees otherwise in writing.

For Private Consumers, applicable statutory rights remain unaffected.

18. Refund Method

Refunds will normally be made using the same payment method used for the original purchase unless another method is expressly agreed.

Refunds will be processed within the applicable legal or contractual timeframe once the return and any applicable inspection have been completed.

19. Relationship With Warranty Policy

This Returns & Refund Policy should be read alongside the Yellowstone Machinery Warranty Policy and the Terms & Conditions of Sale.

A warranty claim is separate from a change-of-mind return.

20. Governing Law

This policy is governed by the laws of England and Wales.

Nothing in this section removes any mandatory rights available to Private Consumers regarding applicable law or jurisdiction.
